OVH RDAP SERVER - TERMS OF USE

This site is designed and hosted by OVH Group and its subsidiaries ("OVH") to provide free, query-based access to a Registration Data Access Protocol server ("RDAP Server") to receive query responses (the "RDAP Responses") and associated query response data (the "RDAP Data") containing sample registration data associated with domains names whose OVH is accredited registrar, in the standard, machine-readable JSON format required by the applicable RDAP protocol specifications (the "RDAP Service").

These Terms of Use (collectively, these "Terms") constitute a legal agreement between OVH and you ("you" or "your") that governs your access to, and use of, the RDAP Service.

THIS IS A LEGAL CONTRACT. PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE RDAP SERVICE YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS, AND ANY ALL POLICIES OR LEGAL NOTICES OVH PUBLISHES OR PROVIDES REGARDING THE RDAP SERVICE.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE RDAP SERVICE.

1. Access and Usage Restrictions.

You acknowledge and agree that:

(a) the RDAP Responses and/or RDAP Data may consist of partial, incomplete, incorrect, supplemented, artificial, and/or reformatted registration data, and should not be relied upon for any purpose other than the Purpose

(b) you will not use the RDAP Service to:

  1. allow, enable, or otherwise support the transmission by e-mail, telephone, postal mail, facsimile or other means of mass, unsolicited commercial advertising or solicitations of any kind
  2. enable high-volume, automated, electronic processes that send queries or data to the systems of any registry operator or ICANN-accredited registrar
  3. infringe or violate the intellectual property rights or proprietary rights, rights of publicity or privacy, or other rights of any third party
  4. violate any law, statute, ordinance, or regulation, including, but not limited to, applicable export and re-export control laws and regulations.

2. Disclaimer of Warranties.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE RDAP SERVICE IS PROVIDED BY OVH ON AN "AS IS", "WHERE IS", AND "AS AVAILABLE" BASIS, WITHOUT ANY REPRESENTATIONS AND WARRANTIES WHATSOEVER. OVH DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR COMPLETENESS OF THE RDAP RESPONSES OR RDAP DATA, WORKMANLIKE EFFORT, OR THAT THE RDAP SERVICE (INCLUDING THE RDAP RESPONSES OR RDAP DATA) WILL BE:

(A) FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

(B) UNINTERRUPTED OR ERROR FREE.

3. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OVH OR ITS AFFILIATES, OR ITS OR THEIR RESPECTIVE OFFICERS, MEMBERS, DIRECTORS, EMPLOYEES, SERVICE PROVIDERS, AGENTS, LICENSORS, SUPPLIERS, SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE "OVH PARTIES") BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING UNDER OR RELATING TO THE RDAP SERVICE OR THESE TERMS (INCLUDING, WITHOUT LIMITATION, LOSS OF BUSINESS, PROFITS, GOODWILL, USE, DATA, OR OTHER ECONOMIC ADVANTAGE), IN EACH CASE WHETHER BASED ON STATUTE, WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT OVH IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

4. Term, Termination and Modification.

(a) These Terms will be effective when you first access and/or use the RDAP Service and will remain in full force and effect so long as you continue to access and/or use the RDAP Service, unless such access and/or use is terminated as set forth in this Section.

(b) OVH reserves the right to discontinue the RDAP Service and/or restrict, suspend, or terminate your access to and use of the RDAP Service at any time in OVH’s sole discretion, including, without limitation, to ensure operational security or stability and for your failure to abide by these Terms. Sections 2 through 4 of these Terms will survive the termination of your access to and use of the RDAP Service.

(c) You acknowledge and agree that these Terms are subject to change by OVH at any time in its sole and unlimited discretion, that you are responsible for checking these Terms periodically for changes and that your use of the RDAP Service after such changes are implemented constitutes your acknowledgement and acceptance of the changes.
